The New Construction Act. What Architects Need to Know

Session Abstract:
Ontario has ushered in the new Construction Act, with amendments to statutory remedies and timelines. Architects practicing in the province should be well versed in how the latest changes impact the delivery of their services. This session will examine the role and obligations of architects in administering construction contracts on behalf of their clients, and how prompt payment and adjudication affect those obligations. The webinar will focus on the strict timeframes imposed by the Construction Act, the intersection of statutory adjudication and the contractual authority of the architect as the decision-maker, and the potential involvement of the architect in adjudication as a witness.

Learning Outcomes:
• To refresh your understanding of the new Construction Act, and which version of the Act applies to a project.
• To learn about the prompt payment rules and how they affect an architect’s obligations to administer the construction contract on the clients’ behalf for contracts on or after October 1, 2019, including how to assist the client with compliance with strict timeframes and notice requirements.
• To learn about statutory adjudication and its impacts on an architect’s duty to interpret contract documents and make decisions. In addition, to learn how an architect may be asked to assist in the adjudication by the parties and/or adjudicator.
• To understand the new Ontario Dispute Adjudication for Construction Contract (ODACC) process for adjudication.

About the speaker:
Andrew Heal, B.A. (Joint Hons.), J.D. LL.M.
Andrew is certified as a Specialist in Construction Law by the Law Society of Upper Canada, and is a principal with the Toronto based law firm Heal & Co. Andrew is a past Chair of the Canadian Bar Association Construction and Infrastructure Law Section, and a past Chair of the Ontario Bar Association and continues to serve those organizations on a volunteer basis. Andrew has practised for over 30 years dealing with construction projects in trouble, and has been an advocate and litigator since 1990. Andrew has been recognized by the Best Lawyers in Canada since 2017, and is a Chartered Fellow of the Construction Lawyers Society of America, and a Fellow of the Canadian College of Construction Lawyers. Andrew is also recognized by Lexpert since 2014 as a leading practitioner in Construction Law, and received the St. James Award for Community Development in 2015, and an Arbor Award for outstanding volunteer service to the University of Toronto in 2020.
