Architects and Prompt Payment (Under the Ontario Construction Act): How Does This Affect Your Practice?

TIME: 11:00 AM - 12:30 PM

Session Abstract:
Join us for a discussion about the prompt payment rules under Ontario’s Construction Act that were introduced in October 2019.  Architects are both subject to, and can avail themselves of, the prompt payment provisions of the Act. Those unfamiliar with their rights and obligations inadvertently risk contravening the law or allowing their rights to expire.

Learning Outcomes:
• Gain an understanding of the core features of the prompt payment rules including payment timelines, invoicing requirements, and notices of non-payment.
• Gain an understanding of the architect’s role and responsibilities in relation to the architectural services contract and in relation to the administration of the construction contract.
• Learn some key considerations regarding prompt payment when acting in the role of a consultant retained directly by the project owner.
• Learn some key considerations regarding prompt payment when acting in the role of a consultant retained by a design-builder or in the role of a subconsultant.
• Learn some key considerations regarding prompt payment when performing contract administration.
