Architects and Adjudication (Under the Ontario Construction Act): How Does This Affect Your Practice?

Session Abstract:
Join us for a discussion about the adjudication process under Ontario’s Construction Act that was introduced in October 2019.  Depending on the nature of what is being adjudicated, the Certificate of Practice holder – who may or may not be retained for construction phase services -- may be requested by a party to an adjudication to provide an opinion about the intent of construction documents or their adequacy.

Learning Outcomes:
• Gain an understanding of the ins and outs of the adjudication process including how adjudications are commenced and what the key timelines are. 
• Gain an understanding of the architect’s role and responsibilities in relation to the architectural services contract and in relation to the administration of the construction contract.
• Learn what types of disputes can be adjudicated. 
• Learn some of the important differences between adjudication and other methods of dispute resolution such as arbitration and litigation. 
• Learn some key considerations for consultants performing construction contract administration in circumstances where their owner client is engaging in an adjudication with the construction contractor.

About the speaker:
Jeff Scorgie
Jeff Scorgie is a construction lawyer at the law firm WeirFoulds LLP with a practice that focuses on drafting and negotiating contracts and advising on other “front end” aspects of construction projects.  Jeff assists his clients in reviewing, drafting and negotiating all manner of design and construction contracts and providing advice throughout the course projects as disputes or issues arise.
