The role of the architect in contract administration is clearly outlined in the Canadian Handbook of Practice for Architects. However, there is a conflict of interest that most architects and construction lawyers have been aware of for many years, that arises as a result of the design professional acting both as designer and contract administrator on a construction project. This session will attempt to demystify some of the misconceptions around the complexity of contract administration and its many moving parts. Construction lawyers Colin Piercey, Collin Hirschfeld, and Marc MacEwing will share some of the most common mistakes you should avoid making, moderated by Andrea Lee.

At the conclusion of this session, participants will be able to:

  • Recognize the contractual, statutory, ethical, and other legal obligations arising from performance of professional services in the administration of construction contracts
  • Explain liabilities arising from contract administration
  • Differentiate between the misconceptions and truths in contract administration
  • Identify the common mistakes and how to avoid them

The webinar will be led by the following industry experts: Construction lawyers Colin Piercey, Collin Hirschfeld, and Marc MacEwing will share some of the most common mistakes you should avoid making; and moderated by Andrea Lee.

Colin Piercey - B.Sc. (honours), Dalhousie University (1991), LL.B., Osgoode Hall Law School (1996)

Colin Piercey is a partner in the Halifax office of Stewart McKelvey, where he focuses primarily on construction and corporate commercial litigation and arbitration. His practice includes a diverse group of clients, including owners, construction contractors, subcontractors, developers, engineers, insurers, financial institutions, landlords, manufacturers, and shareholders.

Collin Hirschfeld - LL.B., BComm (Health Care Administration) (Distinction), University of Saskatchewan

Collin Hirschfeld is a partner with McKercher LLP and has experience in advising on construction contracts, tendering, construction litigation and dispute resolution, security enforcement, and professional discipline and conduct matters. He has appeared before the Saskatchewan Court of Appeal, the Saskatchewan Court of Queen’s Bench, the Federal Court of Canada, the Tax Court of Canada, and various federal and provincial administrative and professional tribunals.

Marc MacEwing - LLB, University of British Columbia (1979), BA, History (with distinction), University of Victoria (1975)

Marc MacEwing is an Associate Counsel member at the Vancouver office of Clyde & Co. He has extensively practiced construction law since 1982, focusing on builders’ liens, tendering disputes, preparing and analyzing contract documents, and construction-related litigation. Marc is also a member of the editorial board and a contributor to The Continuing Education Society of British Columbia Builders Liens Practice Manual.

Andrea Lee is a partner with Glaholt Bowles LLP and is certified as a Specialist in Construction Law by the Law Society of Ontario. She has practiced exclusively in construction law since her call to the bar in 2006.
