“BIM and digital technologies are becoming commonplace within the construction industry worldwide. The benefits of BIM are widely reported. There are international standards, particularly the recent international standard that is being widely implemented called the ISO19650 standards. Government departments and clients are issuing BIM requirements and specifications, and organisations have their own BIM processes and implementation methods. However, there remains a lack of standardisation, uniform understanding or even one terminology.
The new legal and contractual risks, obligations and liabilities brought on by using BIM are often ignored, leading to expensive misunderstandings which counter the benefits BIM brings. There is little guidance or legal knowledge in this area, and whilst disputes are happening, this is occurring behind closed doors.
What are the common causes of disputes? How do you avoid them? What copyright do you need or have you given up copyright in the BIM 3D models and electronic data that you produce? Are you taking on more duties and risks than you realise? What should a BIM-supportive contract contain? In this session, a leading BIM legal specialist will provide practical guidance on reducing and avoiding common risks, legal issues and obstacles and offer real-life accounts of experiences in this area.”

May Winfield is a senior construction and construction insurance lawyer with over 16 years’ experience. She has worked for various international organisations within the design and construction industry, advising and representing insurers in this area. May was one of the first UK lawyers to start investigating the legal and contractual implications of BIM in depth as far back as 2011, and her 2014 UK Society of Construction Law paper on this issue is still cited worldwide.
May has since co-written a number of leading papers, reports and guidance on different areas of BIM. Most recently, May led teams to draft the JCT Practice Note on BIM, the UK legal and contractual guidance regarding the new BIM international standard, ISO 19650 and the ISO 19650-compliant BIM Information Protocol. May has also written numerous papers and articles on other aspects of construction technology, including 3D printing, drones and modular construction.
May is recognised as one of the leading legal specialists in the area of BIM and construction technology, and speaks at conferences worldwide on the topic; including the opening keynote at a buildingSMART BIM legal conference in Berlin and the opening keynote at the BIMTI conference in Porto. May is a member of various industry groups, including chair of BIM4Legal, core member of 4D Construction Group, and member of the CDBB Digital Twin Roadmap Working Group.
