Ontario’s recently updated excess soil regime creates a new regulatory framework that applies to all construction projects generating “excess soil,” resulting in new standards and obligations that impose additional legal requirements on project stakeholders. The regulatory changes will affect property owners, developers, consultants, and the construction industry as a whole, exposing participants to new risks and legal requirements.
Osler’s Andrew Wong and Jennifer Fairfax discuss how the changes impact various stages of a project including project planning, budgeting and project delivery. The webinar also addresses edits to the construction contracts and consulting service agreements in light of the legislation.
Learning objectives:
• Understand the new legislation and regulatory framework.
• Become familiar with changes in the commercial and legal provisions of construction related contracts.
• Become prepared to explain how the contractors’ and the consultants’ scope of work is different.
• Gain some key take-aways on demonstrating due diligence when addressing excess soil.
