Bill 216, Building Ontario For You Act (Budget Measures), 2024 introduced significant amendments to the Construction Act that directly affect the practice of architects in Ontario. From expanded access to adjudication to the mandatory annual release of holdback, these changes create new risks for architects to navigate, as well as enhanced protection of consultants’ fees. This presentation will provide compliance tips and explore strategies for leveraging the new provisions to recover unpaid fees.

Lena Wang, JD, Partner Glaholt Bowles LLP
Lena is certified as a Specialist in Construction Law by the Law Society of Ontario. Lena has experience working on a variety of disputes related to large infrastructure, industrial and commercial projects. Lena has represented owners, general contractors and architects in proceedings involving liens, trust claims, delay claims and professional negligence claims. Lena’s arbitration experience includes a three week hearing related to the development of a new light rail system, including allegations of gross negligence and project delay. Lena has appeared at all levels of Ontario courts, where she has experience representing clients in all stages of litigation at trial and on appeal. Lena is an Associate of Canadian Surety Bonding (A.C.S.B.), a designation conferred by the Surety Association of Canada, chair of the Advocates Society’s Construction Law Practice Group, and a co-author of the text Annotated Ontario Construction Act. Lena is an Adjunct Professor at Osgoode Hall Law School.
Katie McGurk, JD, Associate, Glaholt Bowles LLP
Since her call to the bar in 2021, Katie McGurk has represented plaintiffs and defendants in various types of civil litigation matters including construction disputes, shareholder disputes, employment matters and property claims. Katie joined Glaholt Bowles LLP in 2023 after practicing at a full service law firm in Hamilton. Katie's practice is now focused exclusively on construction litigation. She has experience representing clients on a variety of infrastructure and commercial projects. She regularly acts for owners, contractors, design professionals and insurers in claims for breach of contract, negligence, delay, liens, breach of trust, and construction deficiencies. Katie studied law at the University of Ottawa and was called to the Ontario Bar in 2021.
